ORDINANCE 04-37

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA, AUTHORIZING USE OF $9,750.00 FROM THE HOMER ACCELERATED ROADS PROGRAM (HARP) FUNDS AND $9,750.00 FROM THE HOMER ACCELERATED WATER AND SEWER PROGRAM (HAWSP) FUNDS FOR SLOPE STABILIZATION OF THE OCEAN BLUFF ON TWO CITY LOTS ALONG OCEAN DRIVE LOOP AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE PROCEDURES.

WHEREAS, Via Ordinance 02-41 Lots 43 and 44 were accepted by the City of Homer and retained for a public purpose and classified as "undesignated"; and

WHEREAS, During a site visit regarding the Ocean Drive Loop Bluff Erosion Control repair work Public Works identified a serious slope erosion issue relating to the City parcels; and

WHEREAS, Public Works assessment was that the condition was hazardous to the health and welfare of the public, the Ocean Drive Loop neighborhood and had the potential of damaging the Erosion Control Project seawall; and

WHEREAS, The slope stabilization work protected the roadway and water distribution infrastructure.

WHEREAS, The slope stabilization costs were $19,500.00; and

NOW, THEREFORE, the City of Homer Ordains:

Section 1. That the use of the HARP and HAWSP Funds are hereby authorized to repay the cost of the slope stabilization work done on the City's property in the Ocean Drive Loop Bluff Erosion Control Project as follows and that the City Manager is authorized to execute the appropriate procedures:
