ORDINANCE 04-44

AN ORDINANCE OF THE CITY COUNCIL AUTHORIZING THE EXPENDITURE OF HOMER ACCELERATED ROADS PROGRAM (HARP) FUNDS FOR THE SPRUCEVIEW AVENUE ROAD RECONSTRUCTION AND PAVING ASSESSMENT DISTRICT PROJECT.

WHEREAS, The City Council adopted Resolution 04-50, May 25, 2004, supporting the creation of a Road Reconstruction and Paving Improvement Assessment District for Spruceview Avenue; and

WHEREAS, Resolution 04-76 notes that there were no objections received during the sixty day objection period, ending August 27, 2004; and

WHEREAS, Assessment payments received from property owners will be placed into the HARP.

NOW, THEREFORE, the City of Homer Ordains:

Section 1. That use of the HARP Funds is hereby authorized for the Road Reconstruction and Paving of Spruceview Avenue Improvements:

Section 2. This ordinance is a budget amendment only, is not of a permanent nature and is a non code ordinance.
