                        AN ORDINANCE OF THE CITY COUNCIL OF HOMER,

                        ALASKA AMENDING HOMER CITY CODE CHAPTERS

                        21.44 RR RURAL RESIDENTIAL DISTRICT, 21.45 UR

                        URBAN RESIDENTIAL DISTRICT, 21.48 CBD CENTRAL

                        BUSINESS DISTRICT, 21.49 GC1 GENERAL COMMERCIAL

                        1 DISTRICT, 21.50 GC2 GENERAL COMMERCIAL 2 DISTRICT,

                        21.52 MC MARINE COMMERCIAL DISTRICT, 21.53 MI

                        MARINE INDUSTRIAL DISTRICT, AND 21.54 OSR OPEN

                        SPACE—RECREATIONAL DISTRICT ADDING USES UNDER

                        LISTED CONDITIONAL USES.

 

     WHEREAS, in evaluating and developing all of this information the Commission considered the recommendations of the Homer Comprehensive Plan and Homer Comprehensive Plan Update; and

 

     WHEREAS, Homer Comprehensive Plan Chapter 7, Economy, Objective One states: “Endorse commercial, government, and private development which preserves and enhances the quality of life that exists in the Homer Community”; and

 

     WHEREAS, Policy 1.3 under Objective One states: “The City shall encourage development of “clean” (non-polluting) industries, such as fishing, tourism, education, retirement, and service industries in Homer”; and

 

     WHEREAS, the 1999 Homer Comprehensive Plan Update, Homer Spit Plan states:

“Manage the land and other resources of the spit to accommodate its natural processes, while allowing fishing, tourism, other marine related development, and open space/recreation uses”;

and

 

     WHEREAS, the 1999 Homer Comprehensive Plan Update, Parks and Recreation section states: “Update plans to include year-round recreational opportunities to residents and visitors”; and

 

     WHEREAS, 1999 Homer Comprehensive Plan Update, Economy section states:  “Year round tourism will be emphasized”; and

 

     WHEREAS, many areas of the City are underutilized during the winter seasons and facilities are needed to promote year-round tourism and sports; and

 

     WHEREAS, expanded opportunity for recreation activities will enhance the quality of life for Homer residents and expand the recreation and tourism segment of the economy; and

 

     WHEREAS, buildings which house seasonal activities may be more fully utilized by allowing off-season sports activities, allowing for maximum benefit of investments and providing greater community benefit by better utilization of land; and

 

     WHEREAS, multi-use buildings with differing seasonal uses will allow for a larger range of goods and services to be available; and

    

     WHEREAS, community-wide needs dictate a more flexible approach to siting facilities designed to serve as places of public assembly for recreation activities,

 

     WHEREAS, the Commission considered the proposed ordinance amendments as they relate to Homer’s future growth, responsibilities and needs; and

 

    WHEREAS, the proposed ordinance amendments were available to the public for review; and

 

     WHEREAS, the Commission held a public hearing on the proposed ordinance amendments on September 1, 2004; and

 

     WHEREAS, the comments were received by the Commission; and

 

     WHEREAS, the Commission carefully reviewed and considered all comments provided on the proposed ordinance amendments.

 

 

     NOW, THEREFORE, THE CITY OF HOMER HEREBY ORDAINS;

 

 

CHAPTER 21.44

 

RR RURAL RESIDENTIAL DISTRICT

 

21.44.030 Conditional uses and structures.  The following uses are permitted in the rural residential district when authorized in accordance with Chapter 21.61:

r.  Indoor recreational facilities such as skating rinks, equestrian arenas or similar uses;

 

s.  Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas or similar uses.

UR URBAN RESIDENTIAL DISTRICT

 

21.45.030 Conditional uses and structures.  The following uses are permitted in the urban residential district when authorized in accordance with Chapter 21.61:

o.  Indoor recreational facilities such as skating rinks, equestrian arenas or similar uses;

 

p.  Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas or similar uses.

 

 

21.48

 

CBD CENTRAL BUSINESS DISTRICT

 

21.48.030 Conditional uses and structures.  The following uses are permitted in the central business district when authorized in accordance with Chapter 21.61:

o.  Outdoor recreational facilities such as skating rinks, miniature golf courses, open air performing arts centers, or similar uses.

 

 

CHAPTER 21.49

 

GC1 GENERAL COMMERCIAL 1 DISTRICT

 

21.49.030  Conditional uses and structures.  The following uses are permitted in the general commercial 1 when authorized in accordance with Chapter 21.61:

n. Indoor recreational facilities such as bowling alleys, skating rinks, equestrian arenas   or similar uses;

 

o. Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas, open air performing arts centers or similar uses.

 

 

CHAPTER 21.50

 

GC2 GENERAL COMMERCIAL 2 DISTRICT

 

21.50.030  Conditional uses and structures.  The following uses are permitted in the general commercial 2 district when authorized in accordance with Chapter 21.61:

r. Indoor recreational facilities such as bowling alleys, skating rinks, equestrian arenas   

or similar uses;

 

s. Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas, open air performing arts centers or similar uses.

 

 

 

CHAPTER 21.52

 

MC MARINE COMMERCIAL DISTRICT

 

21.52.030  Conditional uses and structures.  The following uses are permitted in the marine commercial district when authorized in accordance with Chapter 21.61:

l.  Indoor recreational facilities such as bowling alleys, skating rinks, equestrian arenas

or similar uses;

 

m. Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas, open air performing arts centers or similar uses.

 

 

CHAPTER 21.53

 

MI MARINE INDUSTRIAL DISTRICT

 

21.53.030 Conditional uses and structures. The following uses are permitted in the marine industrial district when authorized in accordance with Chapter 21.61:

m. Indoor recreational facilities such as bowling alleys, skating rinks, equestrian arenas

or similar uses;

 

n. Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas, open air performing arts centers or similar uses.

 

 

CHAPTER 21.54

 

OSR OPEN SPACE—RECREATION DISTRICT

 

21.54.030 Conditional uses and structures. The following uses are permitted in the open space—recreation district when authorized in accordance with Chapter 21.61:

 

(NEW ITEMS)

 

i. Indoor recreational facilities such as skating rinks, equestrian arenas or similar uses;

 

j. Outdoor recreational facilities such as skating rinks, miniature golf courses, golf

courses, driving ranges, batting cages, sports fields, equestrian arenas, open air  performing arts centers or similar uses.

 

 

 

Section 3.            This ordinance is of a permanent and general character and shall be included in the City code.
