ORDINANCE 05-22
AN ORDINANCE OF THE CITY
COUNCIL OF HOMER, ALASKA AMENDING HOMER CITY CODE 21.42.010 CONCERNING ZONING
PERMIT REQUIREMENTS.
THE CITY OF HOMER ORDAINS:
Section 1. Homer
City Code 21.42.010 is hereby amended to read as follows:
21.42.010 Zoning permit required. a. Except as provided in
subparagraph c, a zoning permit shall be obtained from the Planning
Director for the following: {no person shall erect, construct,
enlarge, alter, repair, move, improve, or convert any building or structure, or
cause the same to be done, without first obtaining from the Planning Director a
separate zoning permit for each such building or structure. This applies to all areas in the city.}
1.
Erection, construction or expansion of any building or structure.
2. Site development activities that trigger other review or approval requirements under the Homer Zoning Code, such as but not limited to, the requirement of a site plan, Development Activity Plan or Storm Water Protection Plan.
3. A change or expansion of any building, structure or lot or of any type of use regulated by Homer Zoning Code.
b. The zoning permit required by this section shall be obtained
prior to the commencement of any work, {excavation, construction},
change or expansion of a building, structure, lot or use, or
other {aspect of the work} activity for which the permit
is required. Failure to do so is a violation.

c. The following are exempt from the requirement to obtain a zoning
permit, but not from compliance with applicable requirements of the Homer
Zoning Code, such as, but not limited to the Development
Activity Plan or Storm Water
Protection Plan:
{1.
Ordinary maintenance of a building or structure. For purposes of this section, ordinary
maintenance means repair, maintenance, or improvement work that, separately or
in the aggregate, does not exceed five thousand dollars in cost, provided that
no structural alteration is included.}
1.2. Erection
or construction of a oOne-story detached accessory buildings used as
a tool and storage sheds,
playhouses, and or
other similar accessory
uses, provided the building
footprint roof area does not
exceed 120 200 square
feet, and further provided that there is already a principal building on the
same lot.
2.3. Fences or
walls used as fences, unless
otherwise regulated by Homer City Code.
3. Removal of any building, structure or type of use.
{4. Construction or alteration of interior
partitions or cabinetry, provided that no structural alteration is included.
5. Repair or
replacement of heating, ventilation, air conditioning, electrical, or plumbing
systems.}
Section 2. This Ordinance is of a
permanent and general character, and shall be included in the City Code.
