AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA AMENDING HOMER CITY CODE SECTION 21.48.060(h) CENTRAL BUSINESS DISTRICT LANDSCAPING REQUIREMENTS, BUFFERS AND SECTION 21.49.060(H) GENERAL COMMERCIAL 1 LANDSCAPING REQUIREMENTS, BUFFERS.

 

WHEREAS, The Homer City Council discussed the matter or zoning buffers during their Committee of the Whole meeting on March 14, 2005; and

WHEREAS, The Homer City Council approved Memorandum 05-56(A), on March 29, 2005 during their regular meeting which forwarded a request for amendment to the zoning buffers under landscaping requirements for the Central Business District, General Commercial One, General Commercial Two, Marine Commercial and Marine Industrial Districts.

THE CITY OF HOMER HEREBY ORDAINS:

 

Section 1.  Homer City Code 21.48.060(h) Landscaping Requirements for the Central Business district is hereby amended to read as follows:

 

h. Landscaping Requirements.  All development on lands in this zoning district shall conform to the following:

1. Landscaping shall include the retention of native vegetation to the maximum extent possible and shall consist of the following:

a. Buffers:

i. 3 feet minimum width along all lot lines where setbacks permit; except where a single use is contiguous across common lot lines, such as, but not limited to, shared driveways and parking areas.  Whenever such contiguous uses cease the required buffers shall be installed.

ii. 15 feet minimum from the top of the bank of any defined drainage channel or stream.

 

Section 2.  Homer City Code 21.49.060(h) Landscaping Requirements in the General Commercial 1 District is hereby amended to read as follows:

 

h. Landscaping Requirements.  All development on lands in this zoning district shall conform to the following:

1. Landscaping shall include the retention of native vegetation to the maximum extent possible and shall consist of the following:

a. Buffers:

i. 3 feet minimum width along all lot lines where setbacks permit; except where a single use is contiguous across common lot lines, such as, but not limited to, shared driveways and parking areas.  Whenever such contiguous uses cease the required buffers shall be installed.

 

 

Section 3.  This ordinance is of a permanent and general character and shall be included in the City Code.
