ORDINANCE 05-55
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA,
REAFFIRMING ACCEPTANCE AND DESIGNATED USE OF CERTAIN TAX-FORECLOSED
PROPERTY, KENAI PENINSULA BOROUGH TAX PARCEL ID NUMBERS 177-174-2200 AND
177-270-4900.
WHEREAS, Tax parcel 177-174-2200, also described as Oscar Munson Lot 79, was deeded to the City of Homer in 1984, foreclosed on in 1981 and the deed was recorded Book 143 page 825;
WHEREAS, Tax parcel 177-270-4900, also described as HM0770065 T06S R13W S17 Island View
Subdivision, Bayview Park, this was deeded to the City of Homer May12, 1986, foreclosed on in 1983
and the deed was recorded Book 167 Page 586; and
WHEREAS, The City Council requested that the Parks and Recreation Commission recommend the use
of Lot 79, Oscar Munson Subdivision on Ocean Drive Loop and that they get input from the neighbors;
and
WHEREAS, The Parks and Recreation Commission discussed the use of Oscar Munson Lot 79 on
March 17, April 21 and May 19, 2005, took public testimony on May 19, 2005 and Recommended that
this parcel be retained for the purpose of a green space; and
WHEREAS, Via Resolution 05-53 on June 27, 2005 adopted the Homer 2005 Land Allocation Plan and specifically noted the Parks and Recreation Commission recommendation that Oscar Munson Lot 79 be dedicated as a green space.
NOW THEREFORE, THE CITY OF HOMER ORDAINS:
Section 1. The City of Homer hereby reaffirms acceptance of the following foreclosed property as
noted above and referred to herein as Tax Parcel 177-174-2200 and 177-270-4900; and
Section 2. The City of Homer hereby reaffirms the use designation for public purpose of parcel
177-174-2200 as a green space and parcel 177-270-4900 as a park.
Section 3. This ordinance is of a permanent nature and is a non code ordinance.
