ORDINANCE 05-59





AN ORDINANCE OF THE CITY COUNCIL AUTHORIZING THE EXPENDITURE OF HOMER ACCELERATED ROAD PROGRAM (HARP) FUNDS FOR THE W. NOVIEW ROAD RECONSTRUCTION AND PAVING ASSESSMENT DISTRICT PROJECT.

WHEREAS, The City Council adopted Resolution 05-78 on July 25, 2005,finding the need to create the W. Noview Road Reconstruction and Paving Improvement District; and

WHEREAS, A public hearing was held on Monday, August 22, 2005 during a Regular City Council Meeting; and

WHEREAS, Resolution 05-107, adopted on October 24, 2005, notes that there were 3 and one half written objections received during the sixty day objection period, ending October 21, 2005; and

WHEREAS, Assessment payments received from property owners will be placed into the HARP.

NOW, THEREFORE, the City of Homer Ordains:

Section 1. That use of the HARP Funds is hereby authorized for the W. Noview Road Reconstruction and Paving Improvements:

Section 2. This ordinance is a budget amendment only, is not of a permanent nature and is a non code ordinance.

Fiscal Note: Property owner assessments $135,491.60. Total estimated project cost is $387,384.00. Assessments are: $30 per front foot for reconstruction and $17 per front foot for paving. This is a Homer Accelerated Roads Program (HARP) Project. The remainder of the project cost will be paid by the HARP.
