ORDINANCE 06-04

AN ORDINANCE OF THE CITY COUNCIL AUTHORIZING THE USE OF WATER/SEWER UTILITY RESERVE FUNDS TO REIMBURSE THE ALASKA DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES (ADOT/PF) $41,130.94 FOR THE STERLING HIGHWAY HOMER HILL UTILITY PROJECT 59282 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE APPROPRIATE DOCUMENTS.

WHEREAS, The City Council adopted Resolution 96-42 on May 13, 1996, authorizing the execution of an Agreement with ADOT/PF for the relocation and/or adjustment of certain utility facilities and execution of a Reimbursable Service Agreement (RSA) 52376; and

WHEREAS, Originally, the funds were to come from the Water and Sewer Reserve; and

WHEREAS, The City of Homer benefitted from this project, the official invoice was received by City Finance on November 21, 2003 and both parties are now satisfied with the amount and appropriateness of the invoice.

NOW, THEREFORE, the City of Homer Ordains:

Section 1. That the use of Water/Sewer Utility Reserve Funds is hereby authorized and appropriated to reimburse ADOT/PF for the Sterling Highway Homer Hill Utility project and that the City Manager is authorized to execute the appropriate documents:
