ORDINANCE 06-07(A)

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER AMENDING THE OFFICIAL ROAD MAINTENANCE MAP OF THE CITY OF HOMER BY ADDING 4800 LINEAL FEET OR .909 MILE OF RURAL ROAD, IN TULIN TERRACE SUBDIVISION.

WHEREAS, The City of Homer has determined that it is necessary to provide minimum standards to regular design and construction of public streets, roads, and highways within the City of Homer; and

WHEREAS, Ordinance 85-14, HCC 11.04.055, adopted July 2, 1985 provides appropriate street design and construction standards as well as an official maintenance map to record streets officially accepted for maintenance; and

WHEREAS, HCC 11.04.055 provides that the City shall not accept maintenance responsibility for any road or street which is not constructed or reconstructed to the adopted standards unless the road is shown on the Official Road Maintenance Map, as amended via Ordinance 02-23(S), adopted June 10, 2002, of the City of Homer; and

WHEREAS, An additional 4800 lineal feet has been duly inspected, reviewed, approved by the Department of Public Works and recommended for acceptance by the City of Homer as Rural Road.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. Section 11.04.55 Official Road Maintenance Map adopted is hereby amended per provisions of sections (a) through (e) to included the following additional street as an Urban Road by the City of Homer and recorded as amendments #11 - #17 on the New Official Road Maintenance Map adopted: The following mileage calculations are to the nearest thousandth.

Section 2. This is a non code ordinance and of a permanent nature.

Section 3. Public Works Conditions:

• City maintenance would not start until there are people living in the subdivision. (One of the conditions that must be met to receive rural road maintenance is there must be one residence for every 300 lineal feet of road maintained. This would suggest that at least 12 homes might have to be built before the City would begin to maintain all roads within the subdivision. I would expect that the City would extend maintenance in stages, based on where the first residents live.)

• Maintenance provided would be to the Rural Road standards.

• The cul-de-sac's (Whisper, Meadow, Tulin Bluff West, and Tulin Bluff East Courts) be enlarged ( 80 diameter) and be contained within the dedicated street right-of-way and provide adequate maneuvering room for emergency vehicles as directed by the Public Works Director.

• Drainage easements shall be executed across several lots to accommodate drainage ditches that currently direct surface water from the roads on to and across adjacent lots as directed. (Some of these situations could be resolved by relocating drainage ditches into street right-of-way.)

• Make minor modifications to the submitted plan and profile drawings to document the above work and add minor items (such as road grades in percent, etc.) as directed by Pubic Works.

• [For a period of two years after acceptance of the roads by the City Council and completion of the work described above), the subdivision owner shall be responsible for repairing any portion of the road that does not support vehicular traffic.]

• For a period of two years following construction density, which would result in road maintenance activities taking place that the subdivision owner shall be responsible for repairing any portion of the road that does not support traffic.
