ORDINANCE 06-13





AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AMENDING HOMER CITY ZONING MAP TO REZONE TO GENERAL COMMERCIAL ONE (GC1) PORTIONS OF RURAL RESIDENTIAL (RR), URBAN RESIDENTIAL (UR) AND RESIDENTIAL OFFICE (RO) ZONING DISTRICTS FRONTING EAST END ROAD IN THE EAST HILL AREA.



WHEREAS, The lots fronting the East End Road on the north side to be rezoned as Central Business District are: Rosebud Subdivision lots 02 and 03 KPB #s 179-050-0200 and 0300, Hugh Watson Record of Survey KPB # 179-030-1300, Mutch Gangle Tracts Neptune Addition Lots 1, 2 and 5 KPB #s 175-030-6200, 6300 and 6600; and

WHEREAS, The lots fronting the East End Road on the south side to be rezoned as Central Business District are: Metes and Bound Legal Descriptions KPB #s175-030-1700, 1800, 2100, 2200 and 2700; and

WHEREAS, The Homer Comprehensive Plan, Chapter 1., C. Light Industrial Land Use Business/Commercial Land Use addresses the General Commercial I District (GCI) and was updated with the 1999 Comprehensive Plan Update and included new goals, objectives and action items:

A. Provide for areas within the Homer City Limits that encourage and promote businesses with Industrial uses.

1. Continue to support industrial land use needs while maintain public safety, and increase performance standards in areas currently designated as light industrial land uses.

2. Pursue annexation of land suitable for commercial/industrial uses, especially those presently served by City water and/or sewer.

3. Minimize land use conflicts, to the extent possible, between industrial and other land uses.

Action items.

1. Determine the feasibility and desirability of expanding a mixture of uses out East Road or on the Sterling Highway north of the Homer Middle School.

2. Revise the zoning code to allow for residential and other land uses, with the stipulation that industrial uses are given priority in land use conflicts.

WHEREAS, Adding this section of town to the GC1 District is complementary to the Comprehensive Plan, its 1999 update, goals, objectives and actions; and the City Code; and

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. The Homer City Zoning Map be amended to rezone portions of Rural Residential, Residential Office Urban Residential Zoning Districts to General Commercial One District as depicted in Exhibit A. Map and Exhibit B. legal descriptions.(attached to this document, scroll down)

Section 2. The City Clerk is authorized to sign the map and adhere to the requirements as set forth in Homer City Code Section 21.36.020(c); and

Section 3. This Ordinance is of a permanent nature and is a non code Ordinance.
