AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE CHAPTER1.72
TITLE TO READ PORT AND HARBOR ADVISORY COMMISSION AND AMENDING SUB
SECTION 1.72.010(A) COMMISSION--CREATION AND MEMBERSHIP, TO CHANGE THE
NOT MORE THAN TWO MEMBERS MAY BE FROM OUTSIDE THE CITY LIMITS TO NOT
MORE THAN THREE MEMBERS MAY BE FROM OUTSIDE THE CITY LIMITS.
WHEREAS, The Port and Harbor Advisory Commission is noted as such in Section 1.72.010 and
that any reason for this title reading Harbor Advisory Commission certainly does not appear to exist
today; and
WHEREAS, The Commission was called the Port and Harbor Advisory Commission in 1973 and it
appears that when the City Code was revised that the name did not carry over in the new title of the
new chapter; and
WHEREAS, There are many non City residents with interests in the City's port, harbor, fish dock,
and on the Homer Spit; and
WHEREAS, There are non City residents who own businesses associated with the port and harbor; and
WHEREAS, Homer's Port and Harbor are used by the Homer area community members and port
and harbor fees are paid by the Homer area community citizens; and
WHEREAS, These non City residents have expressed their desire to be able to participate in City
decisions with regard to the Port and Harbor; and
WHEREAS, Currently up to, two non City resident members are allowed on the Commission; and
WHEREAS, Allowing one more member to be a non City resident does not mean that all three have
to be non City residents, but that up to three may be non City residents; and
WHEREAS, A majority of resident members is still required.
NOW THEREFORE, the City of Homer Ordains:

Section 1. That Homer City Code Chapter 1.72 is hereby amended to officially rename the Harbor
Advisory Commission to the Port and Harbor Advisory Commission.
Section 2. That Homer City Code subsection 1.72.010(a), Commission - Creation and Membership is
hereby amended to read as follows:
1.72.010 Commission--Creation and membership. a. There is created the City of Homer Port and Harbor Advisory Commission, referred to in this chapter as the Commission. Such Commission will be made up of seven members, who shall be nominated by the Mayor and confirmed by the City
Council. Not more than[ two] three member(s) may be from outside the City limits.
b. A Chairman and Vice-Chairman of the Commission shall be selected annually and shall be appointed from and by the appointive members.
c. The Mayor, the City Manager, the Port Manager and the Harbormaster shall serve as consulting
members of the Commission in addition to the seven appointive members, and may attend all meetings
as consultants, but shall have no vote. (Ord. 84-4 '1,1984; Ord. 73-12 §1, 1973; prior code §7-400.1).
Section 3. This ordinance is of a permanent and general character and shall be included in the Homer City Code.
