ORDINANCE 06-17

AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE AMENDING SUB SECTION 1.76.010(B) HOMER ADVISORY PLANNING COMMISSION ESTABLISHED, TO CHANGE THE NO MORE THAN ONE OF ITS MEMBERS MAY BE FROM OUTSIDE THE CITY LIMITS TO NO MORE THAN THREE OF ITS MEMBERS MAY BE FROM OUTSIDE THE CITY LIMITS

WHEREAS, There are many non City residents who own businesses inside the City limits and therefore, pay City property taxes on those businesses and who collect City sales tax; and

WHEREAS, Many non City residents use City facilities, pay City fees and City sales taxes; and

WHEREAS, The non City residents who own businesses inside the City are affected by Planning and Zoning decisions just as much as the City resident business owners; and

WHEREAS, Many of the non City residents have expressed their desire to be able to participate in City decisions with regard to Planning and Zoning matters; and

WHEREAS, Currently one non City resident member is allowed on the Commission; and

WHEREAS, Allowing two more members to be a non City residents does not mean that all three have to be non City residents, but that up to three may be non City residents; and

WHEREAS, A majority of resident members is still required; and

WHEREAS, Many Alaska Cities do not have Planning Commissions and these duties fall to their Borough or to their City Council; and

WHEREAS, Many of the Alaska Cities have less than a seven member Planning Commission with one member allowed to be from outside the City limits and some have less than a five member Commission.

NOW THEREFORE, the City of Homer Ordains:

Section 1. That Homer City Code subsection 1.76.010(b), Homer Advisory Planning Commission established, is hereby amended to read as follows:

1.76.010 Homer Advisory Planning Commission established. a. In order to maximize local involvement in planning, and in the implementation and modification of the Homer zoning ordinance, the Homer Advisory Planning Commission is established. Advisory Planning

Commission jurisdiction is limited to the area within the City boundaries.

b. The Homer Advisory Planning Commission shall have seven members. No more than[one] three of its members may be from outside the City limits. Members shall be appointed by the Mayor subject to confirmation by the City Council.

c. A chairman and vice-chairman of the Commission shall be selected annually and shall be appointed from and by the appointive members.

d. The Mayor, City Manager or his designee and Public Works Director, or his designee, shall serve as consulting members of the Commission in addition to the seven appointive members, and may attend all meetings as consultants, but shall have no vote. (Ord. 82-15, 1982; Ord. 79-12, 1979; prior code 16-100.1).

Section 2. This ordinance is of a permanent and general character and shall be included in the Homer City Code.
