ORDINANCE 06-18

AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE SUB SECTION 1.78.010(A) ECONOMIC DEVELOPMENT ADVISORY COMMISSION TO CHANGE A MINIMUM OF FIVE COMMISSIONERS TO A MINIMUM OF FOUR COMMISSIONERS SHALL RESIDE WITHIN THE CORPORATE LIMITS OF THE CITY OF HOMER AND TO AMEND ALL REFERENCES TO THE OVERALL ECONOMIC DEVELOPMENT PLAN IN HOMER CITY CODE CHAPTER 1.78 TO THE COMPREHENSIVE ECONOMIC DEVELOPMENT STRATEGY.

WHEREAS, The Homer Economic Advisory Commission was reactivated by the City Council via Resolution 06-20 adopted during a Regular City Council meeting held on February 27, 2006; and

WHEREAS, There are many non City residents who own businesses inside the City limits and therefore, pay City property taxes on those businesses and who collect City sales tax; and

WHEREAS, Many non City residents use City facilities, pay City fees and City sales taxes; and

WHEREAS, The non City residents who own businesses inside the City are affected by Economic Development just as much as the City resident business owners; and

WHEREAS, Many of the non City residents have expressed their desire to be able to participate in City decisions with regard to local economics; and

WHEREAS, Homer City economics affect the area wide economics; and

WHEREAS, Currently two non City resident members are allowed on the Commission; and

WHEREAS, Allowing one more member to be a non City residents does not mean that all three have to be non City residents, but that up to three may be non City residents; and

WHEREAS, A majority of resident members is still required; and

WHEREAS, The Overall Economic Development Plan has been changed to the Comprehensive Economic Development Strategy by the Economic Development Administration (EDA) and therefore should be changed in our City Code.

NOW THEREFORE, the City of Homer Ordains:

Section 1. That Homer City Code subsection 1.78.010(a), Homer Economic Development Advisory Commission Creation and Membership, is hereby amended to read as follows:

1.78.010 Commission--Creation and membership. a. There is created the City of Homer Economic Development Advisory Commission, referred to in this chapter as the Commission. Such Commission will be made up of seven members, who shall be nominated by the Mayor and confirmed by the City Council. A minimum of[ five] four commissioners shall reside within the corporate limits of the City of Homer and shall be registered voters in the Kenai Peninsula Borough or the City of Homer.

b. A Chairman and Vice-Chairman of the Commission shall be selected annually and shall be appointed from and by the appointive members.

c. The Mayor, the City Manager, and one Councilmember shall serve as consulting members of the Commission in addition to the seven appointive members, and may attend and participate in all meetings as consultants, but shall have no vote. (Ord. 93-15(S)(A), 1993)

Section 2. That all references to the Overall Economic Development Plan or OEDP in Homer City Code Chapter 1.78 shall be changed to the Comprehensive Economic Development Strategy or CEDS.

Section 3. This ordinance is of a permanent and general character and shall be included in the Homer City Code.
