ORDINANCE 06-29

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA AMENDING SECTION 17.04.030 AUTHORIZATION AND PROPOSAL, BY ADDING A SENTENCE REQUIRING CONSTRUCTION OF SEWER IMPROVEMENTS PRIOR TO/ OR WITH WATER IMPROVEMENTS.

NOW, THEREFORE, THE CITY OF HOMER HEREBY ORDAINS:

Section 1. That the Homer City Code section 17.04.030 be a mended to add a sentence to read as follows and that the rest of section 17.04.030 shall remain in force and intact as though fully set forth herein:

17.04.030 Authorization and proposals. The Council may create local improvement districts and assess the real property benefitting from such capital improvements for all or a portion of the cost of such improvements. Under HCC Chapter 17.04, no water main improvements may be constructed before sewer main improvements without the formal authorization of the Homer City Council via Resolution. An improvement proposal may be initiated by:
