ORDINANCE 06-34
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA,
ACCEPTING DONATED PROPERTY, KENAI PENINSULA BOROUGH (KPB) TAX
PARCEL NUMBERS 179-390-0300--179-390-0700, AND DESIGNATING ITS USE FOR
PUBLIC PURPOSE AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE
APPROPRIATE DOCUMENTS.
WHEREAS, Pursuant to Homer City Code 18.06.010 Real property acquisitions, authority. a. The
City may acquire, own and hold real property within or outside the City boundaries by any lawful
means or conveyance, and may exercise all rights and powers in the acquisition, ownership and
holding of real property as if the City were a private person; and
WHEREAS, The property owners of record of KPB Tax parcel numbers 179-390-0300 through 0700 have contacted the City Manager regarding donating said parcels to the City of Homer to be used for public purpose; and
WHEREAS, Pursuant to Homer City Code 18.06.020 Real property acquisitions, form; procedure,
the City Manager ordered Title Insurance; and
WHEREAS, Kachemak Heritage Land Trust is not interested in the parcels since this is such a
small sized area in total, less than one acre.
NOW THEREFORE, THE CITY OF HOMER ORDAINS:
Section 1. The City of Homer hereby accepts the donation of property described as follows:

Section 2. The above described property is hereby dedicated and designated for public
purpose/public use for the benefit and enjoyment of the community at large. Uses may include, but
are not limited to, an equestrian or other park, trails, playgrounds, picnic areas, greenbelt; provided
however, that the land may not be developed for commercial or residential use nor sold to private parties.
Section 3. The City Manager is hereby authorized to execute the appropriate documents.
Section 4. This ordinance is of a permanent nature and is a non code ordinance.
