ORDINANCE 07-02(A)

 

AN ORDINANCE OF THE CITY COUNCIL AMENDING HOMER CITY CODE SECTION 1.12.030, CONFLICT OF INTEREST, PROCEDURE FOR DECLARING.

 

            WHEREAS, Members of the Council may, from time to time, have personal interests which may influence their opinion and vote on topics brought before the Council for discussion and implementation; and

 

            WHEREAS, These conflicts may result in disparate treatment of issues, if the Council member is allowed to vote, when the topic may benefit a particular Council member more than the community as a whole; and

 

            WHEREAS, The Council recognizes the best decisions are formed with completely open discussion by the full Council and when all Council members are able to participate in the voting process; and

 

            WHEREAS, The Council desires to prevent conflict voting from providing disproportionate benefit to any Council member; and

 

            WHEREAS, The Council believes that if a Council member is NOT in conflict to the degree that they should not be allowed to vote, they should NOT be considered in conflict to the degree that they should not be allowed to participate in the discussion preceding the vote.

 

            NOW, THEREFORE THE CITY OF HOMER ORDAINS:

 

            Section 1. That Homer City Code Section 1.12.03, Conflict of Interest, Procedure for Declaring is hereby amended to read as follows.

 

            1.12.030 Procedure for declaring. A City Councilmember or Mayor with a substantial financial interest or other disqualifying conflict of interest under section 1.12.020 shall so declare to the body as a whole and ask to be excused from voting on the matter participating in the discussion and the vote.[ However, a City Councilmember or Mayor with a conflict of interest, regardless of whether excused from voting, shall not be allowed to participate in discussion about the matter.] (Ord. 92-49(A) 4, 1992; Ord. 86-22(S) 1(part), 1986).

 

            Section 2. This ordinance is of a permanent and general character and shall be included in the Homer City Code.
