ORDINANCE 07-41(A)
AN ORDINANCE OF THE
WHEREAS, Decommissioning the underground fuel tank at the Pratt Museum and replacing it with an above ground, double walled tank at a different location has been a top priority for the Board of Directors for a number of years; and
WHEREAS, Although there is no evidence that the tank is leaking at this time, the Pratt has been advised by its insurance company and architectural and engineering consultants that it is a potential hazard in part, because it is located so close to Woodard Creek; and
WHEREAS, The Homer City Council placed this project on its Legislative CIP List in an effort to secure funding for the project; and
WHEREAS, The project was approved this year by the Legislature but vetoed by the Governor; and
WHEREAS, In her veto message, Governor Palin stated that this project was not a State responsibility and the Council has concluded that projects of this type probably will not be funded by the State in the future; and

Section 1. That the City Council hereby amends the FY 2007 Operating Budget by approving and appropriating a capital project grant in an amount not to exceed $25,000 for the purpose of decommissioning the underground fuel tank at the Pratt Museum and constructing a new one above ground.
