ORDINANCE 07-47

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER AMENDING THE OFFICIAL ROAD MAINTENANCE MAP OF THE CITY OF HOMER BY ADDING 2,083 LINEAR FEET OF ROAD IMPROVEMENTS TO SOUNDVIEW AVENUE, SHELLEY AVENUE, TAJEN LANE AND CABANA COURT, OR   .40 MILES OF URBAN ROAD.

 

            WHEREAS, The City of Homer has determined that it is necessary to provide minimum standards to regular design and construction of public streets, roads, and highways within the City of Homer; and

 

            WHEREAS, Ordinance 85-14, HCC 11.04.055, adopted July 2, 1985 provides appropriate street design and construction standards as well as an official maintenance map to record streets officially accepted for maintenance; and

           
            WHEREAS, HCC 11.04.055 provides that the City shall not accept maintenance responsibility for any road or street which is not constructed or reconstructed to the adopted standards unless the road is shown on the Official Road Maintenance Map, as amended via Ordinance 02-23(S), adopted June 10, 2002, of the City of Homer; and


            WHEREAS, An additional 2,083 linear feet has been duly inspected, reviewed, approved by the Department of Public Works and recommended for acceptance by the City of Homer as Urban Road.

           
            NOW, THEREFORE, THE CITY OF HOMER ORDAINS:


            Section 1. Section 11.04.55 Official Road Maintenance Map adopted is hereby amended per provisions of sections (a) through (e) to include the following additional streets as Rural Road by the City of Homer and recorded as amendments #19 - 22# on the New Official Road Maintenance Map adopted: The following mileage calculations are to the nearest hundredth.

            Section 2. This is a non code ordinance and of a permanent nature.

            Section 3. Public Works Conditions:

 

City maintenance would not start until there are people living in the subdivision. The City will begin to maintain Shelley Avenue, Tajen Lane and Cabana Court when the first home is built on each road. Soundview Avenue maintenance will be initiated immediately. Maintenance provided would be to the Urban Road standards for all roads.
