ORDINANCE 07-50

 

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA AUTHORIZING THE DESIGN AND INSTALLATION OF AN ADDITIONAL 4,400 LINEAR FEET OF WATER MAIN ALONG KACHEMAK DRIVE TO COMPLETE THE LOOP BETWEEN THE AIRPORT AND EAST END ROAD AND APPROVING THE CREATION OF A DEFERRED ASSESSMENT DISTRICT.

 

            WHEREAS, A 14,500 foot dead end water main now exists on East End Road ending at its intersection with Kachemak Drive and another 6,500 foot dead end main exists along Kachemak Drive behind the airport; and

 

            WHEREAS, Completing the Phase II water main extension along Kachemak Drive will extend the East End Road dead end main another 8,000 feet; creating a 22,000 foot long dead end main; and

 

            WHEREAS, Dead end lines can result in water quality problems, restricted fire flows, and longer interruptions in service to customers if damage occurs to the line; and

 

            WHEREAS, Completing the loop between East End Road and the airport ( 4,400 linear feet) at the same time the Phase II water main is installed will result in construction cost efficiencies, improved water quality, stronger fire flows, and better overall service to all water customers along East End Road and Kachemak Drive; and

 

            WHEREAS, The additional 4,400 linear feet of water main can be constructed using Homer Accelerated Water and Sewer Program (HAWSP) funds and deferred assessments can be established for benefiting properties so that property owners make no payments until they connect to the line. 

 

            NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

 

            Section 1: The Homer City Council finds that completing the water main loop between the airport and East End Road is a public health and safety priority and in the overall best interest of the community.

 

            Section 2: The Council hereby authorizes the expenditure of $600,000 in HAWSP funds for the design and installation of 4,400 linear feet of additional water main along Kachemak Drive as shown on the attached map and authorizes the Manager to execute a change order to the existing contract of the engineering firm currently working on Phase II design to conduct the design phase of the work authorized herein.

            Section 3: The Council hereby authorizes that a deferred assessment district be established for the 30 benefiting properties subject to the provisions of the Homer City Code and the HAWSP Manual with the following conditions and stipulations:

 

  • Only lots that front the water main will receive deferred assessments
  • The estimated deferred assessment is $15,000
  • Deferred assessments will be calculated as they would for a normal LID (75% Owner, 25% City)
  • Benefiting Property owners do not pay until they hook up
  • The City will pay for the cost of oversizing the main ( from 8” to 12”)
  • Fire Hydrants will be installed
  • No service stubs will be installed
  • No hook-ups will be allowed until a sewer line is installed

 

            Section 4: This ordinance is a budget amendment only, is not of a permanent nature, and is a non code ordinance.
