ORDINANCE 08-12(S)(A-2)

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AMENDING HOMER CITY CODE TITLE 21 (ZONING) ADDING CHAPTER 21.57 TO THE HOMER CITY CODE CREATING THE SCENIC GATEWAY CORRIDOR OVERLAY DISTRICT TO FURTHER REGULATE DEVELOPMENT IN ALONG THE STERLING HIGHWAY FROM ROGERS LOOP ON THE BAYCREST HILL TO THE INTERSECTION OF THE STERLING HIGHWAY AND PIONEER AVEUNUE.

WHEREAS, The concept of a Gateway District   has been discussed and preliminarily researched in the Planning Department as far back as 2002, and

WHEREAS, A drive down the Sterling Highway from the Scenic Overlook parking area to Central Business District defines the unique image and feel of Homer and the view itself is a valuable natural resource deserving of protection, and

WHEREAS, The is ordinance establishing the Scenic Gateway Corridor Overlay furthers the goals and objectives of the Homer Comprehensive Plan in that it guides the use and future development of this area in a manner that maintains these desirable natural features by managing growth in this unique area in a responsible and restricted manner while preserving the essential beauty and character of this neighborhood as well as the community as a whole; and

WHEREAS, The Sterling Highway from Anchor Point through Homer to the end of the Homer Spit has been designated as a State Scenic Byway.

NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

Section 1. A new chapter HCC 21.57 is hereby added to the Homer City Code consisting of the following sections: 

 

Chapter 21.57

 

SCENIC GATEWAY CORRIDOR OVERLAY DISTRICT

 

21.57.010  Purpose and Intent.

21.57.020  Overlay District Boundaries.

21.57.030  Applicability.

21.57.040  Prohibited Uses.

21.57.050  Signs.

 

 

 

21.57.010 Purpose and Intent.             

 

a.  The primary purpose of the Scenic Gateway Corridor Overlay District is to make additional provisions for preservation of scenic vistas, to enhance the compatibility of development and to minimize future traffic congestion and maintain safety along the Sterling Highway corridor.

 

b. The Scenic Gateway Corridor Overlay District shall overlap and overlay existing zoning districts.  The intent of this district is to have development that is sensitive to the “Gateway” of Homer and provide an additional layer of protection for the panoramic views of the Gateway while furthering the primary purposes of the district.

 

21.57.020  Overlay District Boundaries.          

 

a. The Scenic Gateway Corridor Overlay District will include s all lots abutting the Sterling Highway right-of-way, 150 feet of land from the center line on either side of the Sterling Highway from the intersection of the Sterling Highway and the west end of Rogers Loop Road to the intersection of the Sterling Highway and Pioneer Avenue.  

 

            b. If a lot within the district is subdivided, only those subdivided lots that abut the Sterling Highway right-of-way after the subdivision will remain in the district.

 

21.57.030 Applicability.             

 

a. Unless otherwise noted, the requirements of the Scenic Gateway Corridor Overlay District apply to all development and are in addition to the requirements of the underlying zoning district.  Where the requirements of the underlying district and the overlay district conflict, the more restrictive will apply.

 

b. All non-residential development activity in the Gateway Corridor Overlay District will comply with the applicable sections of the Community Design Manual.

 

c. All development activities, uses, and structures in the Gateway Corridor Overlay District that require a conditional use permit according to the requirements of an underlying residential district (i.e., RR, UR, and RO) will comply with applicable sections of the Community Design Manual. 

 

 

            21.57.040  Prohibited Uses.      

The following uses shall not be allowed in the Scenic Gateway Corridor Overlay District.

a.                   Asphalt manufacture or refining; Paving mixture (batch) plant;

b.                  Automobile and vehicle sales, showrooms and sales lots; vehicle repair or auto repair;  vehicle maintenance; public garage;

c.            c.         Short and long term commercial storage facilities warehousing and mini-storage;

d.Open Air Businesses;

e.            d.         Junkyards; impound yards; automobile wrecking; recycling yards; and similar uses;

f.            e.         Recreational vehicle sales, storage, repair;

g.a.            Welding and mechanical repairs;

h.a.Storage and sale of building supplies, materials and equipment;

i.f.          Mobile home parks;

j.            g.         Service stations;

k.            h.         Car washes, truck washes, and other vehicle washes;

l.i.          Heavy equipment sales, service, and storage;

m.j.          Taxi operation, dispatch office and vehicle fleet parking, storage and  maintenance;

n.k.         Itinerant merchants;

o.            l.          Mobile food service.

 

 

            21.57.050   Signs.        All signs in the Scenic Gateway Corridor Overlay District must comply with the sign code as it applies to the Gateway Business District.

 

Section 2. The Scenic Gateway Corridor Overlay District may be illustrated on the official zoning map or other maps, but the official description of the district is set forth in section 21.57.020, which shall prevail over any inconsistent illustration on a map.

 

 

 

Section 3. This Ordinance is general ordinance of a permanent nature and shall be codified in the City Code.
