ORDINANCE 09-18

 

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING THE FY 2009 BUDGET BY APPROPRIATING $116,075 FROM THE PORT AND HARBOR RESERVES FOR NECESSARY REPAIRS AT THE DEEP WATER DOCK.

 

            WHEREAS, During the 2008 season the Deep Water Dock sustained damages caused by two vessels in separate incidents; and

 

            WHEREAS, The incidents with those vessels resulted in damage to fenders and two pilings with an estimated repair cost of $23,750; and

 

            WHEREAS, The City hired a consulting engineer to inspect the damage and to provide a scope of work and cost estimate to repair it; and

 

            WHEREAS, During the inspection, the engineer identified other items that needed to be repaired including damaged ladders and broken fender timbers; and

 

            WHEREAS, All of the damage identified should be fixed as soon as possible for safety, liability, and operational reasons; and

 

            WHEREAS, An Request for Bids was issued for dock repairs and five contractors responded; and

 

            WHEREAS, The Public Works Director and the Port and Harbor Director reviewed all bids and determined the lowest responsible bidder;

 

            WHEREAS, The full bid amount is $116,075 of which, $23,750 will be reimbursed to the City by the owners of the ships which caused the damage.

 

            NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

 

            Section 1. The Homer City Council hereby amends the FY 2009 Budget by appropriating  $116,075 from the Port and Harbor Reserves for the purpose of repairing the Deep Water Dock as follows:

            Section 2. The Council hereby affirms that the $23,750 to be reimbursed to the City by the owners of the vessels causing damage to the dock shall be deposited into the Port and Harbor Reserves Account.

 

            Section 3. This is a budget amendment ordinance, is temporary in nature, and shall not be codified.
