ORDINANCE 09-19

 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AMENDING THE HOMER CITY ZONING MAP TO REZONE A PORTION OF THE URBAN RESIDENTIAL (UR) DISTRICT TO RESIDENTIAL OFFICE (RO).

 

            WHEREAS, The Homer Advisory Planning Commission reviewed a request to rezone property from the Urban Residential District to the Residential Office Zoning District; and

 

            WHEREAS, The Homer Advisory Planning Commission held a public hearing on the matter on April 1, 2009 as required by Homer City Code, Section 21.95.040; and

 

            WHEREAS, The rezone meets the requirements of 21.95 of an extension of an existing boundary adjacency to an existing zoning district; and

 

            WHEREAS, The Homer Advisory Planning Commission determined there is a public need and justification for the rezone; and

 

            WHEREAS, The Homer Advisory Planning Commission determined the rezone would not have a negative affect on the public health safety and welfare; and

 

            WHEREAS, The Homer Advisory Planning Commission considered the affect of the change on the district and surrounding properties; and

 

            WHEREAS, The Homer Advisory Planning Commission determined that the rezone was in compliance with the Homer Comprehensive Plan.

 

            NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

 

Section 1. The Homer Zoning Map will be amended as per attached Exhibit A, to extend Residential Office zoning to include the entire parcel of:  

 

Lot 19 AA Mattox Subdivision 1958 Excluding the DOT ROW.

Lots 3 through 21, Block 2 Lakeside Village Subdivision Amended,

Lots 2-B, 2-C, 2-D, Block 5 Lakeside Village Subdivision Unit #3

Lot 3, Block 5 Lakeside Village Subdivision Amended

Lot 11, Block 3 Lakeside Village Subdivision Amended

Lot 15, Block 3 Lakeside Village Subdivision Amended

Lot 12B, Block 3 Lakeside Village Subdivision No. 7

Lot 25A Lakeside Village Subdivision Hillfair Addition

Tract A Forest View Subdivision

Jeffery Park Lakeside Village Sub

Section 2.        The City Planner is authorized to sign the map and adhere to the requirements set forth in the Homer City Code, Section 21.10.030(b).

 

Section 3.        This is a non Code Ordinance of a permanent Nature and shall be noted in the Ordinance history of 21.10.030.
