EMERGENCY ORDINANCE 09-49(S)
AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA, APPROPRIATING $15,000 FROM THE PORT AND HARBOR RESERVES TO MAKE EMERGENCY REPAIRS AT THE NICK DUDIAK FISHING LAGOON HANDICAPPED ACCESS RAMP.
WHEREAS, The handicapped access ramp at the Nick Dudiak Fishing Lagoon has experienced erosion caused by wave, storm, and tidal action and much of the protective rock and gravel has been transported away from the ramp; and
WHEREAS, The ramp has been seriously undercut which presents a public health and safety issue and if not addressed quickly, may result in total failure of the ramp; and
WHEREAS, It is necessary to repair the ramp as quickly as possible to ensure public safety, avoid a much larger expense later on, and complete construction before the winter storm season.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF HOMER:
Section 1. The Homer City Council finds that an emergency exists as described in the recitals above requiring immediate repairs to the handicapped access ramp at the Nick Dudiak Fishing Lagoon.
Section 2. The Homer City Council appropriates $15,000 from the Port and Harbor Reserve for emergency repairs at the Nick Dudiak Fishing Lagoon Handicapped Access Ramp as follows:

Section 3. This ordinance is a budget amendment only, is not of a permanent nature, and shall not be codified.
