ORDINANCE 10-30

 

AN ORDINANCE OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING THE FY 2010 OPERATING BUDGET BY APPROPRIATING $205,000 FROM THE GENERAL FUND RESERVE ACCOUNT FOR THE PURPOSE OF ACQUIRING THREE PARCELS IMMEDIATELY ADJACENT TO THE HICKERSON MEMORIAL CEMETERY TO PROVIDE FOR FUTURE EXPANSION.

 

            WHEREAS, The Hickerson Memorial Cemetery is running out of space and will soon need to be expanded; and

 

            WHEREAS, The Hickerson Memorial Cemetery is owned and operated by the City, the regulations governing its operation are contained in HCC 19.04, and the City Council wishes to continue to provide this service to the community;  and

 

            WHEREAS, Chapter 18.06 of the Homer Municipal Code entitled “Municipal Property Acquisition” provides that the City may acquire marketable title to real property through contract or sale;  and

 

            WHEREAS, The property to be acquired is the best available alternative for keeping the cemetery open and available to the community for decades to come; and

 

            WHEREAS, The property to be acquired is described as Lot 11-A (1.682 acres), Lot 11-B (0.935 acres), and Lot 11-C (0.952 acres), Tice Acres Subdivision Replat No. 1, located on Stacey St. and Diamond Ridge Road.

 

            NOW, THEREFORE, THE CITY OF HOMER ORDAINS:

 

            Section 1.  The Homer City Council finds that acquiring these three parcels in is the public interest and hereby amends the FY 2010 Budget as follows:

            Section 2. The City Manager is authorized to execute all appropriate documents including but not limited to, a purchase agreement, title insurance, and contract of sale and to take any additional steps necessary to close the transaction.

 

            Section 3.   This is a budget amendment ordinance, is temporary in nature, and shall not be codified.
