ORDINANCE 99-18(A)



AN ORDINANCE OF THE HOMER CITY COUNCIL AMENDING HOMER CITY CODE CHAPTER 19.08, CAMPGROUNDS, TO INCLUDE A DEFINITION FOR CAMPING SEASON IN SECTION 19.08.020, DEFINITIONS, AND A PROHIBITION IN SECTION 19.08.030, PARKING OR CAMPING PROHIBITED--ENFORCEMENT .



WHEREAS, there is no camping season date set in the Homer City Code; and



WHEREAS, camping during winter months has certain impacts regarding sanitation, health and safety; and

WHEREAS, prior to the 1999 main tourist season Port & Harbor Staff and Public Works Staff spend three weeks on clean up after winter month camping; and



WHEREAS, during winter months restroom facilities are not available; and



WHEREAS, concerns exist regarding snow plowing and other means to provide access to camping areas for emergency vehicles and emergency personnel during winter months; and



WHEREAS, there may be times when the weather is such that the dates of the camping season need to be adjusted; and



WHEREAS, the City Manager has the authority in other municipal matters to declare certain adjustments from time to time depending on existing circumstances.



NOW, THEREFORE, THE CITY OF HOMER ORDAINS:



Section 1. Homer City Code Chapter 19.08, Campgrounds, is hereby amended to add a new subsection d. to definitions to read as follows and renumerate the following definitions as appropriate:



19.08.020 Definitions. For the purposes of this chapter, the words set out in this section shall have the following meanings:



d. "Camping Season" means that period of time from May 1 through September 30.



Section 2. Homer City Code Section 19.08.030, Parking or camping prohibited--Enforcement, is hereby amended to add a new subsection d. to read as follows:



d. Camping in a closed campground is prohibited. Except when a campground is opened under a directive entered pursuant to this subsection, all city campgrounds shall be closed outside the camping season. The City Manager may, for cause, enter a written directive that one or more city campgrounds will be open up to thirty days before and thirty days after the camping season, or for any other period of time specified in the directive. As used in this subsection, "cause" includes, but is not limited to, emergencies, tourist caravans, and other tourist demand outside the camping season.



Section 3. This Ordinance is of a permanent and general character and shall be included in the City Code.
