RESOLUTION 00-109



A RESOLUTION OF THE HOMER CITY COUNCIL AUTHORIZING A COOPERATIVE AGREEMENT BY AND BETWEEN SOUTH PENINSULA WOMEN'S SERVICES, INC. AND THE CITY OF HOMER FOR PARTICIPATION IN THE DEPARTMENT OF COMMUNITY AND ECONOMIC DEVELOPMENT PROGRAM TO APPLY FOR CDBG GRANT FUNDING FOR CONSTRUCTION OF A SHELTER FOR VICTIMS OF DOMESTIC VIOLENCE.



WHEREAS, the South Peninsula Women's Services, Inc. has identified need in the community to construct a Shelter for Victims of Domestic Violence; and



WHEREAS, the City of Homer contemplates submitting on behalf of South Peninsula Women's Services, Inc. an application for CDBG Grant Funds from the Department of Community and Economic Development for the purpose of meeting such needs; and



WHEREAS, the City of Homer and South Peninsula Women's Services, Inc. desire, and are required to, enter into a written cooperative agreement with each other to participate in such CDBG program, and



WHEREAS, the City of Homer and South Peninsula Women's Services, Inc. understand that the City of Homer will act as the applicant and will have the ultimate responsibility to assume all obligations under terms of the grant including assuming compliance with all applicable laws and program regulations and performance of all work in accordance with the contract. Further, Laurentia Chamblee will be the contact person for South Peninsula Women's Services and Carey Meyer, P.E., Public Works Director will be the contact person for the City of Homer for this project; and



WHEREAS, it is understood that the City of Homer and DCED have access to all participants' grant records and authority to monitor all activities.



NOW, THEREFORE, it is mutually agreed between the City of Homer and South Peninsula Women's Services, Inc. as follows:



1. The City of Homer and South Peninsula Women's Services, Inc. must assure that the City of Homer will receive some specific benefit (i.e., usefulness, advantage, return) for the residents of the rural community for a period of approximately 20 years.



2. The City of Homer and South Peninsula Women's Services, Inc. agree to cooperate in the submission of an application for such CDBG grant funds, and agree to cooperate in implementation of the submitted CDBG program as approved by the Department of Community and Economic Development.



Nothing contained in this agreement shall deprive any municipality of any power or zoning, development control, or other lawful authority which it presently possesses.



PASSED AND APPROVED by a duly constituted quorum of the City Council for the City of Homer on this 27th day of November 2000.
