RESOLUTION 00-64



A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE JENNY WAY ROAD RECONSTRUCTION IMPROVEMENT/ASSESSMENT DISTRICT, AND SETTING A DATE FOR PUBLIC HEARING, AUGUST 14, 2000.



WHEREAS, HCC § 17.04.030 requires that one-half or more in value of the property to be benefitted may petition the City Council; and



WHEREAS; a petition was received by the Homer City Clerk on June 12, 2000, with signatures of property owners who equal 67.6% of the assessed value of the property to be benefitted, requesting a road reconstruction improvement district for Jenny Way; and



WHEREAS, the Homer Accelerated Roads Program was created to reconstruct local substandard City roads and/or upgrade existing City roads thereby reducing the maintenance costs, improving access, and increasing property values while improving the quality of life in Homer; and



WHEREAS, Jenny Way falls within the guidelines of the Homer Accelerated Roads Program as a Group IV, non-maintained road; and



WHEREAS, the Homer City Council finds the need to create a local improvement/assessment district pursuant to HCC § 17.04.030 (b) for road reconstruction for the lots fronting Jenny Way; and



WHEREAS, pursuant to HCC § 17.04.040(b) the City Council sets the date for public hearing on the necessity of the improvement and proposed improvement plan.



NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Jenny Way Road Reconstruction improvement/assessment district and sets the date for public hearing of August 14, 2000 at a Regular Council Meeting.
