RESOLUTION 01-05



A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, NOTING THE FAILURE OF THE OCEAN DRIVE LOOP BLUFF EROSION CONTROL IMPROVEMENT/ASSESSMENT DISTRICT AND REQUESTING FURTHER EVALUATION OF THE EROSION CONTROL SITUATION ON OCEAN DRIVE LOOP BLUFF.



WHEREAS, Resolution 00-89(a) was adopted September 25, 2000 creating the LID and a public hearing was scheduled and held November 27, 2000 to hear objections or protests to the formation of such assessment/improvement district after property owners of the district were duly notified by certified/return receipt mailing of such hearing and legal notice of hearing being advertised in a local weekly newspaper for four consecutive publications; and



WHEREAS, the objection deadline for written protests was January 26, 2001, eight written objections representing 13 lots and approximately 54.89%; three written non objections representing 4 lots and approximately 21.89%; one written request for more research representing 1 lot and approximately 4.5%; and 7 non responses representing 8 lots and approximately 21.51% were received by the City Clerk's Office; and



WHEREAS, the Seabreeze Court front footages appear to have been miscalculated and that factor has been taken into consideration in the official tabulation of objections and non objections; and



WHEREAS, the property owners submitting written statements have noted the following:

High estimated cost at $937.20 per front foot. Request for research on obtaining grants and/or other funding. Concern that property owners attempting to protect their own property will create a patchwork appearance on the bluff that will be aesthetically displeasing. Request for a comprehensive plan. Some property owners state that their lot(s) is/are not experiencing any depreciative erosion. Request for an opportunity to discuss some alternatives with the City Manager and an engineer. The City should consider the varying degrees of erosion along the bluff and work already done by some property owners. Assessments are much greater than property values. Request for unaffected areas to be deleted from the district. Comments regarding inaccurate front footage and/or useable front footage amounts. Request to continue to consider and research ways to combat this serious problem. Request to revise boundaries and show City property, rights-of-way etcetera. Incorporate better long term assessment financing through loans, grants etc. Note from a property owner that one lot no longer exists. Request to proceed with the improvement, but to lower the cost to the property owner at least to $450 per foot.



NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Homer, Alaska, noting the failure of the Ocean Drive Loop Bluff Erosion Control Improvement/Assessment District and Requesting Further Evaluation of the Erosion Control Situation on Ocean Drive Loop Bluff.
