A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER TO STATE THE CURRENT POLICY CONCERNING SALE OF SURPLUS WATER TO END USERS OUTSIDE THE CITY'S CERTIFICATED SERVICE AREA.
WHEREAS, a Resolution provides the current City Council the opportunity to express their reasoning and intent of their actions; and
WHEREAS, the present and past Councils have been very generous in allowing use of City water outside of the City, and that this is not a normal state or national practice; and
WHEREAS, the present and past Councils have been very clear that the continuing state legislative cuts to municipal assistance and revenue sharing are having dramatic impacts on the extent of services that may be provided; and
WHEREAS, a prudent and fiscally responsible City Council should continually examine the services it provides and the nature of how the recipients of these services are willing to participate; and
WHEREAS, there has been much concern expressed lately that the availability of City water outside of the City is helping, in many instances, growth and development without the balance of any land use controls or zoning, (urban sprawl and impact to remote way of life); and
WHEREAS, there has also been much concern expressed that development and growth outside of the City that has been enabled by City water directly competes with property values and businesses inside the City; and
WHEREAS, any areas desiring municipal services have privileges under state law to incorporate in different forms to be eligible for grants, assistance, etc. for the development of water systems; and
WHEREAS, private sector has continually expressed their capability to provide efficient services, but require certain capitalization and development periods, that will not be initiated unless the intent of the Council is clear; and
WHEREAS, for years, much of the emphasis of expansion and upgrades to the City water system has been for supply, in part due to growth demands of water outside of the City, while simultaneously many have asked Council to concentrate on growth of the existing distribution system (mains and supply lines) within the City; and
WHEREAS, the Homer City Council, as a continued show of generosity and good faith, desires to make it very clear that their current intent is not to restrict current use and amounts by existing water end users outside of the existing certified water service area, but instead, the Homer City Council desires to start to effect the changes required to address the concerns express in this Resolution.

NOW, THEREFORE BE IT RESOLVED, that surplus water continue to be made available in a quantity to allow existing end users outside of the City to continue to receive water equivalent to the current usage, but no water will be made available to new end users outside of the certificated services area, this is subject to change by further Resolution of the City Council; and
BE IT FURTHER RESOLVED, that current policies for water to boats or ships at the harbor or water use for fire suppression, or public projects are not being changed at this time by the Council; and
BE IT FURTHER RESOLVED, that the Council has no problem with more than one private sector water reseller delivering water, nor does the Council deem it necessary to limit the de minimis (5 gallon bucket) method of water delivery; and
BE IT FURTHER RESOLVED, that end users be identified by physical address by bulk water haulers.
