A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA TO REPEAL MEMORANDUM 01-46 (A) AND AMENDMENT AND MEMORANDUM 01-51 DESIGNATING BEN WALTERS PARK AS THE FUTURE HOMER SKATEBOARD PARK SITE AND TO DIRECT THE CITY MANAGER TO INITIATE A NEW SITE IDENTIFICATION PROCESS AND TO RETURN A SKATEBOARD PARK SITE RECOMMENDATION TO THE HOMER CITY COUNCIL FOR CONSIDERATION AND APPROVAL

WHEREAS, the covenants for the establishment of Ben Walters Park may be in conflict with the Council's intended use of the park as a future Skateboard Park site; and

WHEREAS, the Grantee of the land presently known as Ben Walters Park has communicated with the Homer City Council that the covenants do not support the City's intended use of Ben Walters Park as a Skateboard Park; and

WHEREAS, the Council supports keeping Ben Walters Park intact and in a natural state not further disturbing or encroaching on wetlands.

NOW, THEREFORE, BE IT RESOLVED that the City of Homer, Alaska repeals Memorandum 01-46(A) and Amendment and Memorandum 01-51designating Ben Walters Park as the future site of the Skateboarding Park. The Homer City Manager is further directed by the Council to research possible skateboard sites and to return a new site recommendation to the City Council for consideration and approval. The recommendation will include a construction plan, all City estimated costs associated with construction and Skateboard Park operation, and a Skateboard Park operation plan.

PASSED AND ADOPTED by the Homer City Council this 10th day of September, 2001.
