RESOLUTION 01-79



A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE THOMPSON DRIVE SEWER IMPROVEMENT/ASSESSMENT DISTRICT AND SETTING THE DATE FOR PUBLIC HEARING AS JANUARY 14, 2002.

WHEREAS, a Thompson Drive Sewer District failed on August 13, 2001 via Resolution 01-54 and Council granted a 90 day period for re initiation and redistricting at the 50%/50% assessment level; and

WHEREAS, the property owners met that deadline and the district was redefined and reviewed by Public Works; and

WHEREAS, the Homer City Council finds the need to create a local improvement/assessment district pursuant to HCC 17.04.030 (b) for sewer those lots fronting East Road and adjacent to Thompson Drive; and

WHEREAS, the district is desired by property owners who signed the petition in favor of the sewer improvements that equal 73.94% of the property value of the property to be benefitted by the improvements in the redefined Thompson Drive Sewer District with one condition from a property owner requesting that parcel 179-240-01 be included in the public hearing and objection period; and

WHEREAS, the assessment to the property owners, at this time is $10,000.00 per parcel and will probably change with the additional parcel, which will be duly noted for the public hearing and objection period; and

WHEREAS, a public hearing is required as well as advertising at least once a week for four consecutive weeks in a newspaper of general circulation within the City.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Thompson Drive Sewer improvement/assessment district and sets the date for public hearing as January 14, 2002 at a Regular Council Meeting.
