RESOLUTION 02-04

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKAAUTHORIZING THE EXECUTION OF THE STANDARD FORM OF DESIGN-BUILD AGREEMENT AND GENERAL CONDITIONS BETWEEN OWNER AND DESIGN-BUILDER, THE FIRMS OF PHUKAN, INC. AND COAST RANGE CONSTRUCTION, ON BEHALF OF THE PROPERTY OWNERS WITHIN THE OCEAN DRIVE LOOP BLUFF EROSION CONTROL PROJECT, UPON RESOLUTION OF COST ISSUES.

WHEREAS, The City Council adopted Resolution 01-87(S) on November 13, 2001, that awarded the Design/Build Contract for the Ocean Drive Loop Bluff Erosion Control Project to the Firms of Phukan, Inc. and Coast Range Construction and authorized the City Manager to execute the initial Preliminary Design-Build Agreement between the Owner and Design-Builder; and

WHEREAS, The Public Works Department, Design-Builder and the property owners have met several times and a solution to the bluff erosion has been identified; and

WHEREAS, The project can be constructed within the Assessment District/Local Improvement District budget established via Resolution 01-22 and the Preliminary Assessment Roll; and

WHEREAS, Resolution 01-89(S) authorizes the expenditures for reimbursement from bonds for this project in the amount of $1,039,875.00.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska authorizes the execution of the standard form of design-build agreement and general conditions between owner and design-builder, the firms of Phukan, Inc. and Coast Range Construction, on behalf of the property owners within the Ocean Drive Loop Bluff Erosion Control Project, upon resolution of cost issues.

PASSED AND ADOPTED by the Homer City Council this 14th day of January, 2002.
