RESOLUTION 02-22





A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AUTHORIZING THE FORMATION OF THE REFORMED THOMPSON DRIVE SEWER ASSESSMENT DISTRICT AT 50% PROPERTY OWNER SHARE OF ASSESSMENTS AND AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE PREPARATION AND CONSTRUCTION OF THE THOMPSON DRIVE SEWER PROJECT.

WHEREAS, The Reformed Thompson Drive Sewer District boundary contains the lots fronting on East Road better described as Guy Waddell Boundary (replat Broderson Tract D-A) Tract D-A-1, Thompson Subdivision Lot 2, Guy Waddell Boundary Survey E. 165 feet of S. 532 Feet, Tract H of Guy Waddell Boundary Survey SLY 266 feet thereof, Tract A Scenic View Subdivision Lot 1, Thompson Subdivision Resub. Lot 1 Tract E. Lot 1B and Scenic View Subdivision Mary Allen 1981 Replat 2-A, Lot 2-A; and

WHEREAS, Resolution 01-54 was adopted on August 13, 2001 noting the failure of the Thompson Drive Sewer District and granting a 90 day period for recreation/reformation of this district to be assessed at the 50% property owner share level; and

WHEREAS, Resolution 01-79 was adopted on November 13, 2001 creating the reformed Thompson Drive Sewer District and added parcel 179-240-01; and

WHEREAS, A public hearing was held on January 14, 2002, with no public testimony, after property owners of the district were duly notified by certified/return receipt mailing of such hearing and legal notice of hearing being advertised in a local weekly newspaper for four consecutive publications; and

WHEREAS, the objection deadline for written protests was March 14, 2002 with the receipt of no written objections equaling 0% objection and one non objection received; and

WHEREAS, it has been determined that the Thompson Drive Sewer improvements are desired by the property owners who bear more than fifty one percent of the total project assessments to the property to be benefitted pursuant to HCC 17.04.050; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of Homer, Alaska that the formation of the Thompson Drive Sewer Assessment District is Authorized at 50% property owner share of assessments and that the City Manager is authorized to proceed with the preparation and construction of said project.

Fiscal Note: Total estimated project cost: $120,000.00. Total Property owner assessments at 50%: $65,000.00. The City's share will be funded from the Homer Accelerated Water and Sewer Program. Total assessment per parcel is $9,285.71.
