RESOLUTION 02-25

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER, ALASKA, AUTHORIZING THE DONATION OF LOTS 39-44 OF W.R. BENSON SUBDIVISION TO THE U.S. FISH AND WILDLIFE SERVICE PURSUANT TO HOMER CITY CODE SECTION 18.12.060, FOR THE HEADQUARTERS FOR THE ALASKA MARITIME NATIONAL WILDLIFE REFUGE AND KACHEMAK BAY RESEARCH RESERVE AND VISITOR CENTERS AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE QUIT CLAIM DEED.

WHEREAS, The City of Homer, its Council, Commissions and public have voiced support of the U.S. Fish and Wildlife Maritime Refuge Center since 1991; and

WHEREAS, Resolutions 93-102, 94-107, 95-3(A) were adopted in support of the Alaska Maritime National Wildlife Refuge Headquarters and Center and Resolution 98-14, reiterated the City Council's strong support of that center and the National Estuarine Research Reserve; and

WHEREAS, Homer City Code Section 18.12.060, Disposal of surplus real property to governmental entities, provides for the City to donate any real property no longer needed for public purpose to the United States or any agency thereof, if the City Council determines the transaction is advantageous to the City; and

WHEREAS, the land is better described as: Lots 39-44 W. R. Benson Subdivision, Plat No. 67-565, Homer Recording District, Third Judicial District, State of Alaska, lying South of the Southerly right-of-way line of the Sterling Highway.

NOW, THEREFORE, BE IT RESOLVED that the Homer City Council hereby authorizes the donation of Lots 39-44 of W.R. Benson Subdivision to the U.S. Fish and Wildlife Service for the Headquarters for the Alaska Maritime National Wildlife Refuge and Kachemak Bay Research Reserve and Visitor Centers and that the City Manager is authorized to execute the Quit Claim Deed.
