A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, AMENDING THE TERMINAL USE PERMIT, SECTION 8., COMPENSATION, A. PERMIT FEE FROM TEN PERCENT (10%) TO FIVE PERCENT (5%)

WHEREAS, after careful review of the Terminal Use Permit agreement it has been determined that an amendment is necessary regarding compensation.

NOW, THEREFORE, BE IT RESOLVED that the City Council of Homer, Alaska, hereby amends the Terminal Use Permit, Section 8., Compensation, A. permit fee from ten percent (10%) to five percent (5%) as follows:

Section 8. Compensation.

• As consideration for this permit, Permittee shall pay the City a permit fee equal to ten percent (10%) five percent (5%) of Permittee's charges invoiced to a customer for all services, including but not limited to longshore services, provided by Permittee to any cargo, vessel, vehicle, equipment, or person at the Port of Homer.
