RESOLUTION 02-27(S)

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE HILLSIDE SEWER IMPROVEMENT/ASSESSMENT DISTRICT AND SETTING THE DATE FOR PUBLIC HEARING AS JUNE 24, 2002.

 

            WHEREAS, a Hillside Acres Sewer District failed on August 13, 2001 via Resolution 01-51 and Council granted a 90 day period for re initiation and redistricting at the 50%/50% assessment level; and

 

            WHEREAS, the property owners met that deadline and the district was redefined and reviewed by Public Works; and

 

            WHEREAS, the Homer City Council finds the need to create a local improvement/ assessment district pursuant to HCC 17.04.030 (b) for sewer for those lots fronting West Hill Road and Sterling Highway; and

 

            WHEREAS, the district is desired by property owners who signed the petition in favor of the sewer improvements that equal 71.61% of the property value to be benefitted by the improvements in the redefined Hillside Acres Sewer District; and

 

            WHEREAS, the assessment to the property owners, at this time is $11,464.29 per parcel; and 

 

            WHEREAS, a public hearing is required as well as advertising at least once a week for four consecutive weeks in a newspaper of general circulation within the City.

 

            NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Hillside Acres Sewer improvement/assessment district and sets the date for public hearing as June 24th , 2002 at a Regular Council Meeting.

 

            PASSED AND ADOPTED by the City Council of Homer, Alaska this 13th day of May, 2002.
