RESOLUTION 02-34

A RESOLUTION OF THE HOMER CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE THE GENERATOR EQUIPMENT LOAN AGREEMENT BY AND BETWEEN THE KENAI PENINSULA BOROUGH AND THE CITY OF HOMER.

WHEREAS, The Homer Police Department has had an emergency generator from the Kenai Peninsula Borough since 1982; and

WHEREAS, There has never been a formal written agreement pertaining to ownership, operation and maintenance responsibilities; and

WHEREAS, The Homer Police Department budgets for costs associated with the operation and maintenance of the emergency generator and on larger repair bills the Kenai Peninsula Borough has shared the costs; and

WHEREAS, Within the Generator Equipment Loan Agreement the Kenai Peninsula Borough will assume the cost of all required maintenance and repairs and the Homer Police Department will pay for fuel, oil and antifreeze and assure compliance with the periodic test and three day fuel supply requirements.

NOW, THEREFORE, BE IT RESOLVED by the Homer City Council that the City Manager is hereby authorized to execute the Generator Equipment Loan Agreement by and between the Kenai Peninsula Borough and the City of Homer.

PASSED AND ADOPTED by the Homer City Council on this 28th day of May, 2002.
