RESOLUTION 03-104

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA AMENDING THE CITY OF HOMER FEE SCHEDULE, PORT/HARBOR DEPARTMENT FEES, BY ADDING A NEW RATE FOR HANDLING REGULATED GARBAGE.

WHEREAS, The MARPOL Regulated Garbage Certification (covering the handling of food scrap waste from foreign - going ships) for the Port of Homer was recently canceled by the USCG and the Bureau of Customs and Border Protection's Agriculture Quarantine Inspection Department; and

WHEREAS, This action was taken due to failure of the garbage hauling service to properly handle this regulated waste; and

WHEREAS, This necessitated setting up a new system for hauling the regulated waste for incineration of this regulated waste in Anchorage; and

WHEREAS, The fees for transport are $750.00 per round trip for the certificated truck plus $83.00 per hundred pounds of regulated garbage for incineration to cover costs for providing service; and

WHEREAS, The rate needs to be included in the fee schedule; and

WHEREAS, Regulated Waste Disposal Agreements were executed with ENTECH, Alaska, LLC and AIRLINE SUPPORT COMPANY of Anchorage, Alaska to bring the Port of Homer back into compliance, application made with the Bureau of Customs and Border Inspection for a Compliance Agreement and submittal to the USCG to have the MARPOL Garbage Certificate reissued for the Port of Homer.

NOW, THEREFORE, BE IT RESOLVED by the Homer City Council that the City of Homer Fee Schedule, Port/Harbor Department Fees, is hereby amended to add a new rate for handling regulated garbage to read as follows:

Regulated Garbage Handling Fee

$750.00 per round trip for certificated truck pickup plus $85.00 per one hundred pounds

BE IT FURTHER RESOLVED, that the Council approves of the Agreements with ENTECH, Alaska, LLC and AIRLINE SUPPORT COMPANY of Anchorage, Alaska, and supports the application for Compliance Agreement and submittal for re issuance of the MARPOL Garbage Certificate; and

BE IT FURTHER RESOLVED, that the City Manager is authorized to execute the appropriate documents.
