RESOLUTION 03-105(S)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER NOTING THE INSUFFICIENCY OF THE PETITION FOR
KACHEMAK DRIVE PHASE II WATER AND SEWER IMPROVEMENTS.
WHEREAS, The petition was circulated from June through July, 2003, with a filing deadline of July 31, 2003; and
WHEREAS, Signatures from property owners in favor of the water and sewer improvements equal 50.896% of the property value; and
WHEREAS, At least 51% is required for petition sufficiency pursuant to HCC 17.04.030(b); and
WHEREAS, This does not preclude further petitioning by property owners for water and/or sewer or any other improvements; and
WHEREAS, Pursuant to HCC 17.04.030(c)(2) this same improvement district may not be submitted for at least six months from the date of
the adoption of this Resolution; and
WHEREAS, Pursuant to HCC 17.04.030(c)(3) a request for these same improvements with modifications to the area or improvement district
boundary may not be filed sooner than thirty days from the date of the adoption of this Resolution.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer notes the insufficiency of the petition for Kachemak
Drive Phase II water and sewer improvements; and
BE IT FURTHER RESOLVED by the City Council that this same improvement district may not be submitted for at least six months from the
date of the adoption of this Resolution nor may a request for these same improvements with modifications to the area or improvement district
boundary be filed sooner than thirty days from the date of the adoption of this Resolution.
PASSED AND ADOPTED by the City Council of Homer, Alaska this 11th day of August, 2003.
