RESOLUTION 03-109

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, PLACING A BALLOT MEASURE ADDRESSING THE ISSUE OF SIZE OF RETAIL AND WHOLESALE BUILDINGS IN THE HOMER CENTRAL BUSINESS DISTRICT ON THE OCTOBER 7, 2003 GENERAL MUNICIPAL ELECTION.

 

WHEREAS, the Homer City Council has approved a temporary ordinance stating that no retail business, wholesale business, or a combination of the two, shall exceed 20,000 square feet of floor area in the Homer Central Business District, and

 

WHEREAS, the Homer Central Business District (CBD), includes all land surrounded by Lake Street, Pioneer Avenue, and the Sterling Highway (By Pass), and

 

WHEREAS, the provisions of the temporary ordinance shall lapse in six (6) months or upon the City Council adopting standards and procedures for construction of retail and wholesale buildings with 20,000 square feet or more of floor area, and

 

WHEREAS, Ordinance 03-25 (S)(A), reduces the temporary retail and wholesale building size limitation set in January, 2003 from 40,000 square feet of floor space for retail and wholesale business construction to 20,000 square feet of floor area, and

           

WHEREAS, development and location of large retail or wholesale buildings, especially within the Central Business District, has generated lengthy discussion among City Council members and resulted in public testimony and citizen communication with Council members both for and against the construction of retail and wholesale businesses having more than 20,000 square feet of floor area, and

 

WHEREAS, it is the desire and responsibility of the Homer City Council to adopt a permanent ordinance that reflects a size limitation, either through a separate ordinance or as a part of development standards ordinance, for retail and wholesale buildings within the Central Business District that best reflects the will of the majority of the residents of the City of Homer.

 

NOW, THEREFORE, BE IT RESOLVED by the Homer City Council that:

 

The following advisory questions about size limits on retail and wholesale buildings in Homer are to be submitted to the voters at the next Regular, General Municipal Election, October 7, 2003:

ADVISORY QUESTIONS ABOUT SIZE LIMITS ON RETAIL AND WHOLESALE BUILDINGS IN THE HOMER CENTRAL BUSINESS DISTRICT

 

 

The Homer City Council has approved a temporary ordinance stating that no retail business, wholesale business, or a combination of the two, shall exceed 20,000 square feet of floor area in the Homer Central Business District.  Lake Street, Pioneer Avenue, and the Sterling Highway (By Pass) surround the Central Business District.  The provisions of the temporary ordinance shall lapse in six (6) months or upon the City Council adopting standards and procedures for construction of retail and wholesale buildings with 20,000 square feet or more of floor area.  The City Council asks for your advisory vote on the following questions:

 

1. Should the City Council enact an ordinance that would place maximum size limits on the size of buildings used for retail and wholesale business in the Homer Central Business District?

Yes ___  No ___

 

2. If a retail or wholesale building size limitation is enacted, and if the development size limitation standard is either 20,000 square feet or 40,000 square feet, which size limit should be enacted?

20,000 sq. ft. ___    40,000 sq. ft. ___
