A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE KACHEMAK DRIVE
PHASE II WATER AND SEWER IMPROVEMENT/ASSESSMENT DISTRICT AND SETTING THE DATE FOR PUBLIC HEARING AS
OCTOBER 13, 2003.
WHEREAS, The Homer City Council finds the need to create a local improvement/ assessment district pursuant to HCC 17.04.030 (d), for
water and sewer for those lots fronting portions of the Northwesterly Kachemak Drive area; and
WHEREAS, Pursuant to HCC 17.04.030(d), the City Council may determine that an improvement is needed, and initiate by passing a
resolution by approval of not fewer than three-fourths vote by the Council so declaring and shall proceed as provided in sections 17.04.040 -
.060 of this chapter; and
WHEREAS, These lots are contained in located within Moore-Holt Subdivision No. 3, Alaska Tidelands Survey No 1234A, H K Davis
Subdivision, Northern Enterprises Subdivision, Lee Cole Subdivision, Port E.W by Kachemak Dr. & H K Davis.& Lee Cole Sub. & on the N
by East Rd& on E by Seal Rock Roost, Government Lots E. and W. of Kachemak Dr, Uminiski 1997 Addition, Charles R. Hart and James O.
Campbell Property Subdivisions; and
WHEREAS, The petition was circulated from June through July, 2003, with a filing deadline of July 31, 2003; and
WHEREAS, Signatures from property owners in favor of the water and sewer improvements equal 50.49% of the property value; and
WHEREAS, At least 51% is required for petition sufficiency pursuant to HCC 17.04.030(b); and
WHEREAS, There is a great need for sewer in this area; and
WHEREAS, Estimated cost for the water and sewer improvements dated May 9, 2003 is $1,937,410.00. Property owners pay 75% and this
equates to $22,704.02 per parcel, at the equal shares assessment methodology; and
WHEREAS, A public hearing is required and has to be advertised at least once a week for four consecutive weeks in a newspaper of general
circulation within the City with notices sent to the affected property owners; and
WHEREAS, There will be a sixty day objection period which begins the day following Public Hearing date of Monday, September 8, 2003 and
ends Saturday, November 8, 2003; and
WHEREAS, After the objection period closes a Resolution will be forwarded to the Council noting the results of the objection period wherein
property owner objections are tallied.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Kachemak Drive Phase II
Water and Sewer improvement/assessment district and sets the date for public hearing as October 13, 2003 at a Regular Council Meeting.
