RESOLUTION
03-12(A)
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, IN COMPLIANCE WITH HOMER CITY CODE 21.42, SETTING FEES FOR ZONING PERMITS.
WHEREAS, Prior to the commencement of any excavation, construction, or other aspect of construction of a building or structure with the exception of those conditions identified in Homer City Code 21.42.010 section C. parts 1-5, a zoning permit is required; and
WHEREAS,
Setting the fee for zoning permits is the a responsibility
of the City Council by Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Homer City Council that:
1.
The A zoning permit fee is maintained at the present
established at the set rate
of 1/1/03 for all non retail and wholesale buildings and structures;
and
2. A zoning permit fee for retail and wholesale buildings and structures of 30,000 square feet or less of building area is set at the standard rate of $250.00; and
3.
A zoning permit deposit
fee for retail and wholesale buildings and structures of more than 30,000
square feet of building areas will be a progressive fee based upon the
following formula: “standard rate of $500.00 multiplied by the number of
outlets operated by or affiliated with the retail or wholesale business/chain
to include all parent company stores and all parent operations under different
banner(s) within the United States of America;” of $300 per one
thousand square feet of gross floor space. This fee shall be used by the City
of Homer for the cost of all studies and investigations reasonably necessary to
review and to determine a finding of approval, approval with condition, or
disapproval of the developer-prepared impact statement report submitted when
the zoning application is filed and as required by City of Homer Ordinance
02-53(S)(A), dated January 13, 2003; and
4.
Any modification to a retail or wholesale structure or building of more than
30,000 square feet of building area and not exempted within Chapter 21.42.010
section C, parts 1-5 of Homer City Code, will require a zoning permit based
upon the total of pre-existing building area and proposed building area as
computed by the permitting fee formula identified in part 3 above; and.

Any portion of the deposit zoning permit fees collected under items 3 and 4 of
this section that remain unused shall be refunded to the applicant upon
expiration of the final appeal process period. An additional fee above the
deposit amount will be assessed the developer prior to issuance of a permit in
order to cover costs of the City’s review and investigation of the developer
impact report should the total costs surpass the fee deposit.
