RESOLUTION 03-15

 

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, DIRECTING CITY ADMINISTRATION TO OBTAIN A FORMAL APPRAISAL OF CITY HALL AND ITS PROPERTY BY A QUALIFIED APPRAISER.

 

            WHEREAS, through Memorandum 02-65, December 9, 2002 the City determined that “the transfer, sale, exchange, or some combination thereof of City Hall and property is in the short and long term best interests of the City,” and

 

            WHEREAS, Memorandum 02-65 directed the Mayor to forward a “letter of correspondence to the University stating that the City of Homer is willing to entertain a proposal for transfer, sale, exchange or some combination thereof for City Hall and property,” and

 

            WHEREAS, the Mayor on January 13, 2003 wrote a letter to the University expressing the City’s “willingness to entertain a proposal and enter discussion with the University staff for the possible transfer, sale, exchange or some combination thereof of City Hall and property,” and

 

            WHEREAS, in accordance with Homer City Code 18.12.010 the Council must give notice by resolution of public sale of municipal property, and

 

            WHEREAS, in accordance with Homer City Code 18.12.020 the Council cannot sell real property for less than its fair market value, and

 

            WHEREAS, if the City receives a proposal of interest from the University regarding the transfer, sale, exchange, or some combination thereof of City Hall and property, the City will need the property  “appraised by a qualified appraiser within the six month period immediately preceding the date of the Council Resolution authorizing same.”

 

            NOW, THEREFORE, THE CITY OF HOMER HEREBY RESOLVES:

 

1.      That administration immediately obtain a formal appraisal of City Hall and its property by a qualified appraiser, and

2.      If the University responds to the Mayor’s letter dated January 13, 2003, that administration working with Council will enter into discussion and negotiation with the University for the possible transfer, sale, exchange, or some combination thereof of City Hall and property.

 

PASSED AND APPROVED by the Homer City Council this 27th day of January, 2003.
