RESOLUTION 03-23
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA, DIRECTING THAT NO NEW PERMITS BE GRANTED FOR RETAIL OR WHOLESALE STRUCTURES EXCEEDING THE SIZE AND DIMENSION LIMITATIONS IN THE DRAFT ORDINANCE PROPOSED AND REFERRED TO THE PLANNING COMMISSION BY RESOLUTION 03-22 PENDING REVIEW OF THE DRAFT ORDINANCE BY THE HOMER PLANNING COMMISSION AND SUBSEQUENT ACTION BY THE HOMER CITY COUNCIL.
WHEREAS, by Resolution 03-22 the Homer City Council has begun the process to consider a draft ordinance that would amend the Homer Zoning Ordinance to place size and dimensional limits on buildings used primarily for retail business, wholesale business, or a combination of the two, and
WHEREAS, certain long term, undesirable, and virtually irreversible consequences might flow from the construction of a building that exceeds the limits proposed in the draft ordinance, and
WHEREAS, in order to prevent that occurrence it is necessary to prohibit the issuance of any permits that would be contrary to the terms of the proposed ordinance during the time that the proposed ordinance is under consideration,
NOW, THEREFORE, BE IT RESOLVED by the Homer City Council that:
1. The Administrative Official, the Planning Department, and the Homer Advisory Planning Commission are hereby directed that no permits or approvals of any kind shall be issued that would allow construction or enlargement of a building or buildings for retail or wholesale business, or a combination thereof, in excess of the size and dimensional limitations contained in the draft ordinance attached to Resolution 03-22.
2. This directive is effective immediately and shall remain in effect until the Homer City Council has taken final action on the pending ordinance after receiving the recommendations of the Homer Advisory Planning Commission pursuant to HCC ยง 21.70.020.
