RESOLUTION 03-35(S)(A)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE SALTWATER DRIVE WATER AND SEWER IMPROVEMENT/ASSESSMENT DISTRICT AND SETTING THE DATE FOR PUBLIC HEARING AS APRIL 28, 2003.

WHEREAS, The failure of a Saltwater Drive Water and Sewer District was noted on August 13, 2001 via Resolution 01-53 and Council granted a 90 day period for re initiation and redistricting at the 50%/50% assessment level; and

WHEREAS, Property owners met that deadline with a re initiation and the district boundaries and project costs were redefined and reviewed by Public Works, City Clerk and the property owners several times to be of the best benefit and to tie in with the Hillside Acres Water and Sewer Assessment Districts; and

WHEREAS, The Homer City Council finds the need to create a local improvement/ assessment district pursuant to HCC 17.04.030 (b) for water and sewer for those lots fronting the Salt Water Drive/Binocular Bluff and Sterling Highway area; and

WHEREAS, The district is desired by property owners who signed the petition in favor of the water and sewer improvements that equal 57.02% of the property value, with the exclusion of the exempt properties, to be benefitted by the improvements in the redefined Saltwater Drive Water and Sewer District; and

WHEREAS, KPB #175-082-1700 was divided into 175-082-4000 and 175-082-4100 and both property owners signed petitions in favor of the improvements; and

WHEREAS, The assessment to the property owners, at this time is estimated at $21,540.00 per parcel, with the deletion of two parcels KPB # 175-082-1800 and 175-082-0600; and

WHEREAS, A public hearing is required and has to be advertised at least once a week for four consecutive weeks in a newspaper of general circulation within the City with notices sent to the affected property owners; and

WHEREAS, There will be a sixty day objection period which begins the day following Public Hearing date of April 28, 2003 and ends at 5 p.m. on Friday, June 27, 2003; and

WHEREAS, After the objection period closes a Resolution will be forwarded to the Council noting the results of the objection period wherein property owner objections are tallied.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Saltwater Drive Water and Sewer improvement/assessment district and sets the date for public hearing as April 28th , 2003 at a Regular Council Meeting.

Fiscal Note: Revised Estimated project cost $1,077,000.00 50% to come from HAWSP, 50% from property owners. Estimated property owner share is $21,540.00.
