A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HOMER FINDING THE NEED TO CREATE THE KACHEMAK DRIVE PHASE I SEWER IMPROVEMENT/ASSESSMENT DISTRICT AND SETTING THE DATE FOR PUBLIC HEARING AS JUNE 23, 2003.

WHEREAS, The Homer City Council finds the need to create a local improvement/ assessment district pursuant to HCC 17.04.030 (b) for sewer for those lots fronting a portion of Kachemak Drive; and

WHEREAS, The district is desired by property owners who signed the petition in favor of the sewer improvements that equal 69.91% of the property value, with the exclusion DOT's properties, to be benefitted by the improvements in the Kachemak Phase I Sewer District; and

WHEREAS, Sewer Service Agreement with the Bay Club and Spearin Item. 1 constitutes signature on the petition; and

WHEREAS, Total project cost is estimated to be $488,400.00, 75% to the property owners is $366,600.00; and

WHEREAS, Homer City Council took action on April 28, 2003, setting the assessment methodology to equal shares per lot; and

WHEREAS, A public hearing is required and has to be advertised at least once a week for four consecutive weeks in a newspaper of general circulation within the City with notices sent to the affected property owners; and

WHEREAS, There will be a sixty day objection period which begins the day following Public Hearing date of June 23, 2003 and ends at 5 p.m. on Friday, August 22, 2003; and

WHEREAS, After the objection period closes a Resolution will be forwarded to the Council noting the results of the objection period wherein property owner objections are tallied.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Homer finds the need to create the Kachemak Drive Phase I Sewer improvement/assessment district and sets the date for public hearing as June 23, 2003 at a Regular Council Meeting.
