RESOLUTION 03-67
A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA
NOTING PUBLIC WORKS ACCEPTANCE OF THE OCEAN DRIVE LOOP BLUFF EROSION CONTROL
IMPROVEMENT PROJECT AS COMPLETE, NOTING THAT THE PROPERTY OWNERS TAKE OWNERSHIP
AND MAINTENANCE RESPONSIBILITIES, FORWARDING THIS ASSESSMENT DISTRICT TO THE
FINAL ASSESSMENT ROLL AND PAYMENT PROCESS AND SETTING A PUBLIC HEARING DATE OF
AUGUST 25, 2003.
WHEREAS, the Ocean Drive Loop Bluff
Erosion Control Improvement District was created via Resolution 00-89(A)
adopted on September 25, 2000; and
WHEREAS, the Ocean Drive Loop Bluff
Erosion Control Improvement/Assessment District was formed and the City Manager
authorized to proceed with identifying funding and preparation and construction
of the property owner requested improvements via Resolution 01-22 adopted on
March 27, 2001; and
WHEREAS, the improvements were
constructed and have been accepted as complete by the Homer Public Works
Department in the final amount of $1,039,875.00; and
WHEREAS, property owners agreed that
upon completion and acceptance by Public Works they would take ownership and
maintenance responsibilities of said improvements; and
WHEREAS, pursuant to HCC §17.04.070
at any time after project completion and acceptance, the Council shall assess
the properties benefited their proportionate share of the cost of the
improvement and that there will be a public hearing.
NOW, THEREFORE, BE IT RESOLVED, that
the City Council of Homer, Alaska hereby note Public Works acceptance of the
Ocean Drive Loop Bluff Erosion Control Improvement Project as complete, that
the property owners take ownership and maintenance of the responsibilities,
that this assessment district is hereby forwarded to the final assessment roll
and payment process and setting a date of August 25, 2003 for public hearing.
