A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA,
DONATING A PARCEL OF LAND TO KENAI PENINSULA HOUSING INITIATIVES (KPHI) PROGRAM
FOR THE CONSTRUCTION OF HOMES BY THE SEA, A COMPLEX OF EIGHT SUPERVISED
LIVING UNITS SUPPORTED HOUSING UNITS FOR LOW INCOME DEVELOPMENTALLY CHALLENGED
CLIENTS. DEEMING THIS TRANSACTION
ADVANTAGEOUS TO THE CITY OF HOMER FOR THE PROMOTION OF A HEALTHY COMMUNITY,
PLACING A PARCEL BACK ON THE PROPERTY TAX ROLLS, INCREASING THE CITY’S UTILITY
CUSTOMER BASE, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THIS TRANSACTION ON
BEHALF OF THE CITY OF HOMER FOR ONE PARCEL, NO. 179-061-01, LOCATED ON THE
SOUTHWEST CORNER OF MATTOX AND EAST END ROAD. NO. 179-061-0200, LOCATED ON THE WEST SIDE OF MATTOX
ONE LOT SOUTH OF EAST END ROAD IN THE MATTOX SUBDIVISION.
WHEREAS,
TO6S R13W S16 Mattox Subdivision Lot 18 Excluding DOT ROW was designated for
resale, TO6S R13W S16 HM0003017 Mattox Subdivision Lot 19, Kenai
Peninsula Borough parcel no. 179-061-0200, via Ordinance 93-17; and
WHEREAS, the Kenai Peninsula Borough assessed value of the lot is $29,100.00; and
WHEREAS, pursuant to Homer City Code 18.12.060, Disposal of Surplus Real Property to Governmental Entities, provides for the City to sell, convey, exchange, transfer, donate, dedicate, or assign any real property no longer needed for public purpose to the United States, the State of Alaska, a political subdivision of the State, or an agency of any of these entities, for consideration agreed upon between the City and the grantee without a public sale or otherwise complying with the provisions of 18.12.010-.050, if the City Council determines the transaction is advantageous to the City. The terms of any such transaction shall be fixed by resolution of the City Council. A transaction may be for less than fair market value and without an appraisal unless otherwise directed by the City Council; and
WHEREAS, KPHI made a presentation at the City Council’s Regular Meeting of April 14, 2003.

NOW,
THEREFORE, BE IT RESOLVED, by the Homer City Council of the City of Homer that
a parcel is donated to KPHI program for the construction of an assisted
living complex supported housing complex, that the Council
deems this transaction is advantageous to the City of Homer for the promotion
of a healthy community, placement of a parcel back on the property tax rolls,
increasing the City’s utility customer base, and that the City Manager is
authorized to execute this transaction on behalf of the City of Homer for one
parcel, Lot 18 of the Mattox Subdivision. Lot 19 of the Mattox
Subdivision, Kenai Peninsula Borough parcel no. 179-061-0200.
