RESOLUTION 03-83(S)

A RESOLUTION OF THE CITY COUNCIL OF HOMER, ALASKA NOTING PUBLIC WORKS ACCEPTANCE OF THE HARRINGTON HEIGHTS WATER AND SEWER IMPROVEMENT PROJECT, ACCEPTING THIS PROJECT FOR CITY MAINTENANCE AND FORWARDING THE ASSESSMENT DISTRICT TO THE FINAL ASSESSMENT ROLL AND PAYMENT PROCESS AND SETTING A PUBLIC HEARING DATE OF AUGUST 25, 2003.

WHEREAS, The Harrington Heights Water and Sewer Improvement District was created via Resolution 94-7, on January 24, 1994; and

WHEREAS, The Harrington Heights Water and Sewer Improvement/Assessment District assessment methodology was changed from 75% City Share to 50% City Share via Resoluton 01-21 adopted April 9, 2001; and

WHEREAS, The Harrington Heights Water and Sewer Improvement/Assessment District was formed and the City Manager authorized to proceed with the preparation and construction of the improvements via Resolution 01-49 adopted on August 13, 2001; and

WHEREAS, The improvements were constructed and have been accepted as complete by the Homer Public Works Department in the final amount of $721,655.51, the assessment district will be based on 50% of $721,655.51, or $360,827.76; and

WHEREAS, Pursuant to HCC ยง17.04.070 at any time after project completion and acceptance, the Council shall assess the properties benefitted their proportionate share of the cost of the improvement and that there will be a public hearing.

NOW THEREFORE BE IT RESOLVED, that the City Council of Homer, Alaska hereby notes Public Works acceptance of the Harrington Heights Water and Sewer Improvement Project as complete, accepts this project for City maintenance and that this assessment district is hereby forwarded to the final assessment roll and payment process and that a public hearing date is set at August 25, 2003.

Fiscal Impact: 50% HAWSP and 50% property owner assessments. Assessment was estimated at $11,596.46. After project completion the assessment amounts are estimated at $7,844.08.
