RESOLUTION 03-86
A RESOLUTION OF THE HOMER CITY COUNCIL DONATING LOT 28, BEAR CREEK HEIGHTS, KPB PARCEL NUMBER 179-370-30, TO THE HABITAT FOR HUMANITIES PROGRAM, DEEMING THIS TRANSACTION ADVANTAGEOUS TO THE CITY OF HOMER FOR THE PROMOTION OF A HEALTHY COMMUNITY, PLACING A PARCEL BACK ON THE TAX ROLLS AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE TRANSACTION.
WHEREAS, Ordinance 90-45(A) designated foreclosed Lots 27 and 28 of the Bear Creek Heights Subdivision for resale; and
WHEREAS, The City Council authorized an appraisal for these lots, with five other foreclosed parcels, and solicitation of bids via Resolution 93-53; and
WHEREAS, There were no bids received during the formal bidding process and two proposals for negotiation were received, Resolution 94-3, to authorize the Interim City Manager to negotiation with one of the proposers was postponed to obtain a legal opinion and both proposals were withdrawn just prior to the Council’s Regular Meeting wherein award was scheduled, February 1994; and
WHEREAS, Pursuant to Homer City Code 18.12.060, Disposal of surplus real property to governmental entities, provides for the City to sell, convey, exchange, transfer, donate, dedicate, or assign any real property no longer needed for public purpose to the United States, the State of Alaska, a political subdivision of the State, or an agency of any of these entities, for consideration agreed upon between the City and the grantee without a public sale or otherwise complying with the provisions of §§ 18.12.010-.050, if the City Council determines the transaction is advantageous to the City. The terms of any such transaction shall be fixed by resolution of the City Council. A transaction may be for less than fair market value and without an appraisal unless otherwise directed by the City Council; and
WHEREAS, Habitat for the Humanities gave a presentation at the City Council’s Regular Meeting of January 14, 2002 and the City Council adopted Resolution 02-30 on May 13, 2002 donating either lot 27 or 28, at the choice of Habitat for the Humanities; and
WHEREAS, Habitat for Humanity, South Kenai Peninsula, Inc. wrote a letter dated May 30, 2003 reporting that a house is currently in the process of being built on lot 27; and
WHEREAS, Lots 27 and 28 are very wet and require considerable site preparation and fill to provide a solid construction pad and well drained yard; and

WHEREAS, If the City Council would approve the transfer of Lot 28, Bear Creek Heights then the site preparation could be done on both lots simultaneously, a much more efficient use of volunteer labor.
NOW, THEREFORE, BE IT RESOLVED by the Homer City Council that Lot 28, Bear Creek Heights, KPB Parcel Number 179-370-30 is hereby donated to the Habitat for Humanities Program that this transaction is deemed advantageous to the City of Homer for the promotion of a healthy community, that this parcel be placed back on the tax rolls and that the City Manager is hereby authorized to execute the transaction.
